SOLVE'S PRIVACY POLICY

Introduction

This Privacy Policy ("Privacy Policy" or "Policy") outlines our general policy and practices regarding the types of information we gather, how we use it and the notice and choice affected individuals have regarding our use of, and their ability to, correct that information. This Policy applies to all personal information we collect from you, whether in electronic, paper, or verbal format.

We may modify this Policy from time to time. We will post any such revisions on this website ("Site"). You can check the Effective Date below to determine when the Policy was last modified. Your continued use of the Site constitutes your consent to the contents of this Policy.

  1. 1. Definitions "Personal Information" or "Information" means information that: (1) is about, or pertains to a specific individual; and (2) can be linked to that individual. "Sensitive Personal Information" means personal information that reveals race, ethnic origin, sexual orientation, political opinions, religious or philosophical beliefs, trade union membership or that concerns an individual's health.

Onward Transfers - Prior to disclosing your Personal Information to a third party, we shall notify you of such disclosure and allow you the choice (opt out) of such disclosure. We shall ensure that any third party for which your Personal Information may be disclosed subscribes to these Privacy Principles or are subject to laws providing the same level of privacy protection as is required by these Privacy Principles and agree in writing to provide an adequate level of privacy protection Data Security - We shall take reasonable steps to protect your Information from loss, misuse and unauthorized access, disclosure, alteration and destruction. We have implemented appropriate physical, electronic, and managerial procedures to safeguard and secure your Information from loss, misuse, unauthorized access or disclosure, alteration or destruction. We cannot guarantee the security of information transmitted via the internet. Data Integrity - We shall only process Personal Information in a way that is compatible with and relevant for the purpose for which it was collected or authorized by you. To the extent necessary for those purposes, we shall take reasonable steps to ensure that your Personal Information is accurate, complete, current, and reliable for its intended use. Access - We shall allow you access to your Personal Information and allow you the opportunity to correct, amend, or delete inaccurate information, except where the burden or expense of providing access would be disproportionate to the risks to your privacy in the case in question or where the rights of persons other than you would be violated. Enforcement - We use a self-assessment approach to assure compliance with this Privacy Policy and periodically verify that our Policy is accurate, comprehensive for the information intended to be covered, prominently displayed, completely implemented and accessible and in conformity with internationally accepted Privacy Principles. We encourage interested persons to raise any concerns using the contact information provided and we will investigate and attempt to resolve any complaints and disputes regarding use and disclosure of Personal Information in accordance with our Privacy Policy. If a complaint or dispute cannot be resolved through our internal process, we agree to dispute resolution using (an independent resource mechanism) as a third party resolution provider.

  4. 4. What Data Does Solve Collect? Information we collect directly – By using the Solve System, we will collect information needed to establish a corresponding risk index. Some information we require is name, email address, employee number, as well as grouping information. Information we collect passively – We may also collect certain passive information. For example, we may collect non-personal information from all visitors to our Site, such as IP addresses; the date and time of the visit; time spent on the site; the type of browsers used (i.e., Firefox, Internet Explorer); the type of operating system used (i.e., Windows, Mac OS); the ISP from which the visitor receives Internet access; and aggregate information regarding what pages users of the site accessed during their visit. This information may be combined with the personal information we collect from users. Cookies – When you visit our Site, we may gather the information necessary to identify your needs and to provide you with better service. Through your use of the Site or registration as a new user, we may request personal information including, but not limited to:

    • Name
    • Contact information including email address and cell phone number
    • Demographic information including postal code, product preferences and interests
    • Internet Protocol ("IP") Address and other persistent identifiers

Content and data posted – Please note that by its very nature this Site allows Users to disclose information, including personal information (such as the User's real name or screen name), about themselves or others. We do not review any content before it is posted and cannot guarantee that we will find and remove all inappropriate content that has been posted to our Site. Tracking activities on the Site – When you are logged into your account, we track the date and time of "general system interactions" such as updating profile information or password reset requests. This information is associated with your username and helps us follow these types of actions taken. We may use non-personal information such as information about the pages visited to improve the design, content and performance of our Site, or to analyze Site usage and the popularity of certain pages of the Site. We may also match the non-personal information we collect from Site visitors (such as page visited) with the personal information. Such combined information is kept confidentially in our secure, internal database. In addition, we may transfer personal information if we acquire other entities or sell Solve. Data Security – We have implemented commercially reasonable safeguards to protect Personal Information that we collect and store. All human performance data used to augment performance algorithms will be de-identified using HIPPA/HITECH de-identification security protocols. Despite these precautions, however, no data security safeguards are foolproof. Unauthorized individuals may find ways to obtain Personal Information from or to access the Site. Please keep in mind that we cannot and do not guarantee that content posted at the Site will not be viewed by unauthorized persons. Any content that you post is at your own risk.

Disclosure to Third Parties We may share your Personal Information with our agents, contractors or partners in connection with services that these individuals or entities perform for, or with, us. These agents, contractors or partners are restricted from using this data in any way other than to provide services for us, or services for the collaboration in which they and we are engaged (for example, some of our products are developed and marketed through joint agreements with other companies). Solve reserves the right to share your Personal Information to respond to any duly authorized information requests of governmental authorities or where required by law. In exceptionally rare circumstances where national, state, or company security is at issue (such as with the World Trade Center Terrorist Act in September, 2001), we reserve the right to share our entire database of visitors and customers with appropriate governmental authorities. We may also be required to disclose your Personal Information in the event of a legal investigation or any such other process where we are required to do so by applicable law or where we have to establish our legal rights or where disclosure is required to prevent or take action regarding illegal activities, suspected fraud, or situations involving potential threats to the physical safety of any person. Please include your zip code for our own recordkeeping.) We will not accept requests via the telephone or by facsimile. We are not responsible for responding to notices that are not labeled or not sent properly, or do not have complete information.
